Gettask Terms and Conditions

1. DEFINITIONS AND INTERPRETATION

1.1. Gettask: Refers to the platform and services provided by Atlantic Cape Trading (Pty) LTD, registered in South Africa, with Taxpayer registration number: 2025/544630/07

1.2. Platform: Refers to the Gettask website and mobile applications.

1.3. User: Refers to any person or entity registered on the Platform, including Requesters and Performers.

1.4. Requester: User who posts a Task and seeks services from a Performer (Level 1 Account).

1.5. Performer: User who offers and performs services for Requesters (Level 2: Individual or Level 3: Company Account).

1.6. Task: A description of a service or project posted by a Requester on the Platform.

1.7. Final Cost: The total fee mutually agreed upon between the Requester and the Assigned Performer for the completion of a specific Task.

1.8. Commission: The 3% fee charged by Gettask to the Performer based on the Final Cost, payable upon Task completion (not less than 30 ZAR)

1.9. Balance: The Performer's account balance with Gettask, used exclusively for the payment of the Commission.

2. REGISTRATION AND ACCOUNT VERIFICATION

2.1. Registration: Users must provide accurate and complete information during the registration process.

2.2. Account Levels and Verification:

  • Level 1 (Requester): Basic registration, required to post a Task.
  • Level 2 (Individual Performer): Requires verification of identity (selfie with ID) to gain access to the "Respond to Task" feature.
  • Level 3 (Company Performer): Requires verification of corporate documentation (COR 14.3) to operate as a business entity.

2.3. Account Status: Gettask reserves the right to suspend or block any User account (Account Status: Blocked) for violations of these T&Cs, providing written notice via email.

3. TASK POSTING AND ASSIGNMENT

3.1. Requester Responsibility: Requesters are solely responsible for providing clear and comprehensive Task descriptions. Posting a Task on the Platform is free of charge (zero platform fees).

3.2. Proposal and Chat: Communications regarding the Task and negotiation of the Final Cost must be conducted via the Platform's chat function.

3.3. Direct Contracting: The contract for the service is directly between the Requester and the Assigned Performer. Gettask is not a party to this contract and is not responsible for the performance or quality of the work.

3.4. Payment Outside Platform: Requesters and Performers must agree on the payment method and terms outside of the Gettask Platform. Gettask does not handle, hold, or facilitate the payment of the Final Cost from the Requester to the Performer.

4. THE GETTASK FINANCIAL MODEL AND COMMISSION (CRITICAL)

4.1. Commission Obligation: The Performer agrees to pay Gettask a Commission equal to 3% (three percent) of the Final Cost for every Task marked as COMPLETED by the Requester, but not less than 30 ZAR.

4.2. Purpose of Commission: The Commission is paid not for generating the lead, but solely to unlock the Performer's Review and Rating resulting from the completed Task.

4.3. Commission Deduction: When a Task is marked as COMPLETED by the Requester:

  • The Commission is immediately deducted from the Performer's Balance.

4.4. Review Publication Hold:

  • If the Commission deduction results in a Negative Balance on the Performer's account, the Performer's:
  • Review and Rating for the completed Task is placed ON HOLD and will not be published on the profile.
  • Profile Visibility is temporarily suspended (hidden from the Directory).
  • Ability to "Respond to Task" is disabled.
  • All restrictions will be immediately lifted once the Performer successfully tops up their Balance to an amount greater than or equal to R0.00 (zero Rand).

4.5. Top-Up: Performers must maintain a sufficient Balance to cover anticipated Commissions. Top-ups are solely for the purpose of maintaining Performer status and reputation.

5. DISPUTES, CANCELLATIONS, AND LIABILITY

5.1. Task Cancellation: A Task may be cancelled by the Requester at any time. No Commission is due to Gettask for cancelled Tasks.

5.2. Dispute Resolution: All disputes regarding the quality of work, non-payment of the Final Cost, or other contractual issues are solely between the Requester and the Performer. Gettask provides the platform for interaction but does not offer mediation, arbitration, or refund services related to the service contract.

5.3. Liability Limitation: Gettask shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the services, or for the cost of procurement of substitute services.

6. GOVERNING LAW AND JURISDICTION

6.1. Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa.

6.2. Jurisdiction: Users irrevocably submit to the exclusive jurisdiction of the South African courts.
